1 These terms and conditions cover all services supplied by Curia, its partners and associates, and all other providers co-operating with Curia or for whom Curia is liable.
2 Curia’s lawyers are Belgian lawyers and are registered with the bars of Brussels and/ or Leuven.
3 The professional liability of Curia, Curia’s partners and Curia’s associates is limited to the amount determined in the relevant professional third-party insurance policy and within the limits of the coverage.
The professional third-party liability of Curia, Curia’s partners and Curia’s associates is covered by a primary policy taken out through the bars of Leuven and / or Brussels with Amlin Europe NV (address: Koning Albert II- laan 9, 1210 Brussel). The insured amount is 1.250.000 euro per claim. This policy provides coverage worldwide for the services offered from Belgium, under reservation of the clarifications and exceptions specified in the policy.
The professional third-party liability of Curia’s partners is covered by a second-ranking policy taken out through AIG Europe Limited (address: Pleinlaan 11, 1050 Brussels) and AG Insurance NV (address: Emile Jacqmainlaan 53, 1000 Brussels). These policies comprise an additional cover of 2.500.000 euro per claim, once the primary policy has been exhausted. These policies provide coverage worldwide for the services offered from Belgium, under reservation of the clarifications and exceptions specified in the policy.
The professional third-party liability of some partners is covered by a third-ranking policy taken out through Gerling – Konzern Allgemeine Versicherungs AG (Tervurenlaan 273 bus 1, 1150 Brussel). This policy comprises an additional cover of 12.250.000 euro per claim, once the primary and second-ranking insurance policies have been exhausted. This policy can only be benefitted from if the insured parties are summoned before a court located on the territory of the EU, Switzerland, Andorra, the Anglo- Normandic Islands, Liechtenstein, Monaco or San Marino.
It is possible, upon explicit request of the client, to conclude an insurance policy for a higher amount for a specific file, provided an additional premium is paid.
4 Except in the case of a specific clause providing otherwise, Curia is not liable for the services provided by third parties, whose services it relies on.
5 Curia's fee statements are payable within 14 calendar days of receipt. Should the client protest the fee statement, he is obliged to react in writing within 14 calendar days. Unpaid bills attract interest charges at the legal rate, as well as compensation for costs of execution occurred by Curia, charged at 10% of the billed amount.
6 Both parties may end their contract at any time, subject to written notification of the other party. Curia however may only cease its services after haven given client the time necessary to find alternative counsel. In such event Curia will correspond its final fee statement to the client, including all its services up until the time of cessation of the agreement, and without being entitled to damages. Curia will resubmit all documentation of the file upon the client's first request.
7 Belgian law is applicable. The parties shall aim at settling possible conflicts outside of court. Before initiating legal proceedings, they will preferably let the judge or any other competent institution at the “Orde van Advocaten” attempt to reach a settlement. Only the courts of Leuven and / or Brussels (depending on the address of the lawyer performing the services) are competent, notwithstanding Curia’s right to undertake legal proceedings before the courts competent for the territory where the client is located.
