1 These terms and conditions cover all services supplied by Curia, its partners and associates, and all other providers co-operating with Curia or for whom Curia is liable.
2 Curia’s lawyers are Belgian lawyers and are registered with the bars of Brussels and/or Leuven.
3 First-rank insurance
The professional liability of Curia, Curia’s partners and Curia’s associates is covered by a primary policy taken out through the “Orde van Vlaamse Balies” (as policy holder) with Amlin Europe NV (address of the Belgian branch: Koning Albert II- laan 9, 1210 Brussel) as main insurer (majority participation of 70%) and Zurich Insurance plc (address of the Belgian branch: Lloyd Georgelaan 7, 1000 Brussel) and KBC Verzekeringen NV (address: Professor R. Van Overstraetenplein 2, 3000 Leuven) as co-insurers, with participations of respectively 25% and 5%.
The insured amount is 2.500.000 euro per claim.
The policy providing the first-rank insurance provides coverage worldwide for the servi-ces offered from Belgium, under reservation of the clarifications and exceptions specified in the policy.
The professional liability of some partners, including their representatives in law and in fact and the persons for whom they are responsible, is also covered by a third-ranking policy taken out through the “Orde van Vlaamse Balies” (as policy holder) with HDI Global SE (address of the Belgian branch: Tervurenlaan 273 bus 1, 1150 Brussel).
This policy comprises an additional cover of 19.750.000 euro per claim per insured year, once the primary and second-ranking insurance policies have been exhausted.
The policy providing the third-rank insurance for lawyers also provides coverage world-wide for the services offered from Belgium, under reservation of the clarifications and exceptions specified in the policy.
4 Except in the case of a specific clause providing otherwise, Curia is not liable for the services provided by third parties, whose services it relies on.
5 Curia's fee statements are payable within 14 days of receipt. Should the client protest the fee statement, he is obliged to react in writing within 14 days. As of the due date, interest charges are due automatically and without further notice, calculated in accordance with the Act of 2 August 2002 with regard to late payments for undertakings and calculated at the legal rate for individuals. Late payments also entail a compensation for costs of execution occurred by Curia, charged at 10% of the billed amount.
6 Both parties may end their contract at any time, subject to written notification to the other party. Curia however may only cease its services after haven given the client the time necessary to find alternative counsel. In such event, Curia submits its final fee statement to the client, including all its services up until the time of the contract’s termination,, and without being entitled to damages. Curia will return all documentation of the file upon the client's first request.
7 Belgian law is applicable. The parties shall aim at settling possible conflicts amicably. Before initiating legal proceedings, they will preferably let the judge or any other competent institution at the “Orde van Advocaten” attempt to reach a settlement. Only the courts of Leuven and/or Brussels (depending on the address of the lawyer performing the services) are competent, notwithstanding Curia’s right to undertake legal proceedings before the courts competent for the territory where the client is located.
